Licensing MBTA Property

Entering onto MBTA-owned land is not permitted without proper
licensing. We receive daily requests from citizens, municipalities and companies that wish to access MBTA-owned land. Some of the possible reasons to seek a license are: to cure an encroachment; to inspect a bridge; to install or maintain utility and telecommunication lines; and to perform environmental testing.

The MBTA has established a simple five-step process for obtaining temporary and long-term access to its property. From this page you can download the proper application form and sample license agreements, obtain contact information, and learn more about the licensing process. Please note that the License Agreement Forms provided are samples. An applicant shall not modify or amend a License Agreement Form. The MBTA reserves the right for itself to modify or amend the language in the License Agreement Forms at anytime. If you have any questions regarding the language in a License Agreement Form, please contact the License Administrator.

Step 1. Download License Application Form (Word Document). If you wish to apply for a license to do construction on or near railroad property, please review the MBTA Railroad Construction Specifications, Part I, Part II and Part III. You should also review the MBTA's insurance requirements for transit, the MBTA's Trenching Policy, and the MBTA Special Instructions (2003) for Transit, and/or railroad licensees as appropriate.

Step 2. Mail six (6) copies of the completed Application Form, six (6) copies of a map of the property and/or construction specifications, and a check for the administrative fee of $500 (payable to the MBTA) to:

Step 3. TRA will seek approval for the License from the MBTA. You will be promptly notified if your request is denied by the MBTA.

Step 4. Review and sign the appropriate MBTA License Agreement
